Terms and Conditions Star Properties Destinations Terms and Conditions for Vacation Rentals Use of premises: The premises shall be used for residential purposes only, and Guest(s) shall peacefully and quietly occupy the same and shall not interfere with the rights of other Guest(s) or neighbors. Guest(s) shall permit no activities on the premises, which are contrary to any law, ordinance and/or fire department or insurance policy provisions. The Guest(s) shall not park or vehicles in any area that will obstruct any adjoining drive except areas designated. All rentals are subject to 12.5% sales and bed tax, a cleaning fee (which varies with the size of the property), resort fees, and a non-refundable 3% processing fee- This goes to the credit card processing company we cannot get it back! Check in time is 4 PM and check out is 10 AM. All paperwork must be complete and signed prior to check-in and the rental application must correctly identify all persons, boats, trailers and cars occupying or visiting the property. Liability insurance is required for all watercraft with a minimum insured amount that varies by property. Inquire at time of making reservation. Payment policy: 25% of total reservation cost shall be charged at time of booking in order to hold reservation. The full balance of rental agreement is due 60 days prior to the arrival date. Acceptable payments: Options include cash, certified check, direct deposit, wire transfer, credit card (visa, MasterCard, discover, or AMEX). Personal or company checks will only be accepted if received prior to deadline date of 60 days prior to arrival with enough time to clear. Hurricane policy and Vacation Rental Insurance: Hurricane season extends from June 1st to November 30th. Renter(s) are encouraged to purchase travel protection insurance to protect their investment, as there are NO refunds for cancellations due to hurricanes or any other natural disasters. Star Properties Destinations, LLC is an authorized retailer of Travel Insurance for your convenience. Trip interruption/Vacation Rental insurance is available to purchase on our website https://starproperties.rentalguardian.com/ at the time of booking but no later than 30 days prior to arrival. Purchasing travel insurance is not required in order to purchase any other product or service offered by Star Properties Destinations. For answers to technical questions about the benefits, exclusions, and conditions of any of the insurance or to evaluate the adequacy of the prospective insurance policy or existing insurance coverage visit www.Insurestays.com Damage Insurance: The included Damage Protection Insurance covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $3000. Any damages that exceed $3000 will be charged to the credit card on file. Missing items are not covered. Please make sure all inventory is accounted for. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000. Certain terms and conditions apply. Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy. The Security Deposit Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Rental Guardian to pay directly Star Properties Destinations, LLC. any amount payable under the terms and conditions of the Security Deposit Protection. Cancellation policy: In the event that Guest provides notice of cancellation to Owners Agent sixty (60) days or more before check-in, any deposit received by Owners Agent shall be refunded to Guest minus a 3% processing fee plus applicable sales tax, if any. Any deposit, rent or fees paid shall become non-refundable sixty (60) days prior to check-in. Owner reserves the right, solely at Owners discretion, to refund on a case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest received less than sixty (60) days prior to check-in due to an emergency. Any deposit, rent or fees retained by Owner pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of claims. Rebooking: A rebooking of a cancelled or modified reservation is subject to a 20% rebooking fee. Smoking Policy: There is no smoking inside any Star Properties Destinations rental property. If smoking has been detected the renter(s) permit Star Properties Destinations to charge the credit card on file $500.00 for smoke removal from the furniture and bedding. Please use care while smoking outside, close the doors behind you so the smoke stays outside. Please properly dispose of any cigarette butts. Pets: Must be approved prior to booking reservation. Additional fees will apply to cover the additional cleaning charges associated with pet hair removal and pest control procedures. Wireless Internet Access: Wi-Fi may be provided by the property owner at no extra charge for your convenience and pleasure. Star Properties Destinations and the homeowners bear no responsibility for losses or damages incurred as a result of connecting to any internet access system when available. Compensation or refunds will not be given for internet outages. Utilities: No compensation will be given for temporary outages of electricity, water, internet or cable services. Outages should be reported immediately to us. The operation and maintenance of these utilities is beyond the owners control. There is a monthly cap for our monthly rentals. Tenant is responsible for any overages. See a Star Properties Destinations agent for confirmation of this cap. Right of Entry: Star Properties Destinations, LLC, the owners or their representatives, subcontractors, exterminators etc. shall have the right to enter the property at reasonable hours for the purpose of making repairs, servicing or inspections. Pest Control: All properties managed by Star Properties Destinations, LLC are under a pest control agreement with a third party licensed pest control company. Insects and bugs are a common unwelcomed guest in the Florida Keys. Our properties are thoroughly inspected prior to every reservation. If any bugs are present during your stay, please notify SPD immediately and allow the pest control company access to the unit. No compensation or refunds will be given for the sighting of an insect or pest. Care of rental units: You are responsible for maintaining the property in a neat, sanitary condition. Mid-stay maid services can be provided if arranged ahead of time and for an extra cost. Upon departure, you are expected to leave the property as you found it; tidy, garbage emptied, all lights turned off, and A/C to 82 degrees. Please run the dishwasher as you are leaving with all remaining dirty dishes. Please pile all dirty towels and all bed linens and start the first load. You will be responsible for any damage or losses to the rental property or any additional cleaning fees over the normal wear and tear. All properties are self-catering. Kitchens are fully supplied but food and other necessities such as spices, dish soap, paper towels and cleaning supplies are not guaranteed to be in the properties. Rental rates are subject to change during holidays, Lobster season, and off-season. Availability status of properties is also subject to change. In the event of a change in the property you have reserved, Star Properties Destinations will make every effort to find a suitable substitution or will refund your deposit in full. Condominium and HOA Approval (if applicable): Guest(s) shall obtain condominium and/or homeowner association approval for the use of common elements. Guest(s) shall comply with all condominium and homeowner association regulations. Additional application fees may apply. Tenant shall be responsible for timely payment of any such fees and additional information required by HOA. Compliance with Regulations: Guest(s) shall comply with all local ordinances and regulations including occupancy and use requirements. Guest(s) are responsible for all occupants and visitors during the term of this Agreement. Violations of Regulations: Violations of occupancy and use restrictions as set forth in local ordinances and regulations may result in immediate termination of this Agreement, eviction and/or fines to the Guest(s). Boat Dockage and Ramp: Most communities will require proof of insurance with a minimum policy amount to bring any watercraft on property. Be sure to ask for details. Disclaimer: Star Properties Destinations and all property owners are not responsible for damage to boats tied to any docks or left on the property as a result of attempted theft, storm damage, improper mooring, etc. Substitute Accommodations: Owner shall make all reasonable efforts to have the rental premises available for Guests rental term. In the event of a natural disaster, fire or other casualty or due to the sale and transfer of ownership of the premises to another party or if Star Properties Destinations is no longer the Property Manager responsible for said premises, If available, Owner will offer a substitute property to the Guest for approval. If Guest rejects the substitute property, then all collected deposits and fees will be immediately returned to Guest, and Owner and Property Manager shall have no further liability or responsibility to Guest. All terms and conditions of this Rental Agreement shall apply to any acceptable substitute rental property. Star Properties Destinations makes every effort to insure each property is in good rental condition. Please remember that the Florida Keys are small island communities and after hours repairs is very difficult. Star Properties Destinations maintains an after-hours emergency contact number but most repairs are only possible during working hours. Eviction Policy: Guest acknowledges and agrees that Owner may remove or cause to be removed from the rental premises any Guest or occupant who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in language or conduct which disturbs the peace and comfort of other guests or neighbors or which constitutes a nuisance or which injures the reputation, dignity or standing of the rental premises or anyone who fails to make a payment of rent at the agreed upon rental rate and fees at the agreed upon times or anyone who fails to check-out at the agreed upon time unless an extension of time is expressly agreed to by the Owner or Owners Agent and the Guest prior to check-out. Admission to and removal from the rental premises are not and shall not be based upon race, creed, gender, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner or Owners property manager, to Guest or occupant and if in writing shall be as follows: You are hereby notified that this establishment no longer desires to entertain you as its guest and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of the state of Florida. If any guest who is asked to vacate early has paid in advance, Owner may retain the entire sum without further notice as liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims. Owner reserves the right to proceed at law with a damages claim. Any Guest who remains or attempts to remain after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested, Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the Guest; however, upon arrest, the Guest(s) shall be deemed to have given up any right of occupancy and to have abandoned such personal property. Representation: Star Properties Destinations, LLC and /or its agent/licensee/property manager are the agents and representatives of the Owner, pursuant to Florida statute 21V-10-033, and will be paid by the Owner. The owner/agent is not responsible for loss, theft, or personal injury. If Guest is entering this Agreement with the premises unseen, Guests signature in this Agreement releases Star Properties Destinations, LLC and /or its agent/licensee/property manager and representatives from any and all deficiencies in the premises Guest may find upon arrival. Lead Based Paint Disclosure: Every tenant of residential real property on which a residential dwelling was built prior to 1978 is notified that such property may present exposure to lead from lead-based paint that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning also poses a particular risk to pregnant women. Liability: By signing below, the Guest warrants that the Guest, and all persons accompanying Guest, agree to hold harmless Star Properties Destinations and its subsidiaries, the Owner of the premises and his agents and assigns, from any liability due to injury, loss of life or loss of property by the Guest or any persons accompanying the Guest.
